A foster parent cannot request an HIV/AIDS test for a foster youth.
Nor will those result automatically be disclosed to the caregiver unless the caregiver has a need to know. The law says that only parents and guardians have permission to release information about a child’s HIV status. Because DSS/CWS are not the parents or guardians, they have to get special permission from the parent or a judge to tell you that a child is HIV+.
A foster parent should never take it upon themselves to request an HIV/AIDS test nor will those result automatically be disclosed to the caregiver unless the caregiver has a need to know.
